Settlement Overview

PLEASE READ THIS WEBSITE AND THE NOTICE CAREFULLY. IF YOU WORKED AS AN OUTBOUND ORDER SELECTOR FOR SYSCO KANSAS CITY, INC. (“SYSCO”), AT THE OLATHE, KANSAS FACILITY ANY TIME DURING THE TIME PERIOD SET FORTH BELOW, YOU MAY BE ENTITLED TO A PAYMENT FROM A CLASS AND COLLECTIVE ACTION LAWSUIT SETTLEMENT.

The Notice pertains to all persons employed as hourly, non-exempt employees who were employed by Sysco at the Olathe, Kansas, facility as outbound Order Selectors, from July 1, 2020, through January 26, 2026 (“Order Selectors”).
 

  • Former Order Selectors Anthony Harms and Michael Tuttle sued Sysco claiming that it did not properly pay them for all hours worked. As such, they allege they are owed unpaid overtime wages, minimum wages, and other related damages from Sysco.
  • Sysco denies these allegations and believes that Order Selectors were and are properly paid for all time worked and received all payments from Sysco to which they are entitled.
  • The Plaintiffs and Sysco agreed to this settlement to avoid the burden, expense, inconvenience, and uncertainty of litigation. The Court preliminarily approved this settlement, but the Court has not made any ruling on the merits of the Plaintiffs’ claims, and no party has prevailed in this action.
  • You may be entitled to money from this settlement. You may have received the Notice because Sysco’s records indicate that you worked as an Order Selector at the Olathe, Kansas facility during the period of July 1, 2020, through January 26, 2026. If you submit a properly completed Claim Form & Release (“Claim Form”) enclosed with the Notice, or submit your claim form online here, by September 18, 2026, you may receive an amount proportional to the number of weeks you worked during that period for Sysco.

If you wish to participate in the settlement and receive the full settlement payment for which you are eligible, submit your Claim Form online here or complete the Claim Form you received with your Notice, and mail it to the Settlement Administrator, as discussed in FAQ 4. Your Claim Form must be postmarked or received online by September 18, 2026.

If you choose to participate in the settlement, you will release the claims discussed in FAQ 8 on the FAQ's page.
